35 CONGRESISTAS PERUANOS PIDEN A LOS SENADORES DE EEUU POSPONER DEBATE DEL TLC Y RENEGOCIAR CAPITULOS AGRARIO Y TEXTIL

PRIMERA CARTA DE WERNER CABRERA - APODERADO DE 35 CONGRESISTAS PERUANOS EN LA DEMANDA ANTE EL TRIBUNAL CONSTITUCIONAL SOBRE EL TLC EEUU/ PERÚ - A LOS 100 SENADORES DE EEUU
35 de 120 Congresistas peruanos, apoyados por la dirigencia nacional y regional agraria y laboral piden al Senado de EEUU postergar la ratificación del TLC y renegociar el capitulo agrario para no profundizar la pobreza, el desempleo, el narcotráfico en el Perú y las migraciones hacia EEUU.

Estimados colegas:
1. Queremos asegurar nuestro apoyo a un TLC superior, dentro de un genuino libre comercio, que permita a la mayoría de los inversionistas en el Perú y EEUU, que son pequeños y medianos, y a los trabajadores rurales y urbanos, participar en una globalización eficiente y equitativa, que asegure el desarrollo sin mayor pobreza ni exclusiones.
2. Representamos en nuestro Congreso unicameral de 120 miembros a la mayoría de los 28 millones de ciudadanos del Perú, la mitad de los cuales viven en situación de pobreza y un 20% en extrema pobreza, a pesar que el PBI del país viene creciendo a tasas cercanas al 6% desde hace unos seis años. Fuimos elegidos como primera fuerza en 18 de 24 regiones, cuyo empleo e ingresos en su mayor parte depende de la producción agropecuaria.
3. El TLC negociado por los regímenes de Bush y Toledo, y apoyado hoy por el de Alan García, ha sido objeto de reajustes en los capítulos ambiental y laboral pero se han dejado intactos los capítulos y temas agrario y textil que afectarían directamente – como productores, comercializadores o consumidores a la totalidad de la población peruana.
4. Pedimos a los Senadores de los EEUU postergar la discusión del texto del TLC (APC) aprobado hace unos días por la Cámara de Representantes de los EEUU (285 votos pero con 132 en contra), por las siguientes razones:
a) En nuestra opinión, el Senado de EEUU debería asegurarse de la legalidad de los procedimientos seguidos en el Perú para aprobar este tratado antes de ratificarlo. Frente a nuestras Demandas de diciembre 2006 y noviembre 2007 el Tribunal Constitucional solo ha postergado su dictamen argumentando que solo podrá hacerlo si se llegara a aprobar el actual texto del TLC.
b) Es innecesario el apresuramiento en el Senado de EEUU ya que la ATPDEA de los países andinos que vence en febrero del 2008 se prorrogará con seguridad por unos dos años a la espera del TLC de Colombia y Panamá.
c) Es nuestra firme convicción – que nos gustaría demostrar- que la aprobación de este tratado en su actual versión perjudicaría a EEUU y al Perú. Al profundizar las desventajas del agro peruano se incrementaría la desigualdad regional y social, la pobreza, el desempleo y precariedad laboral y la producción de coca para el narcotráfico. Por lo tanto aumentaría en vez de disminuir la presión migratoria de peruanos empobrecidos hacia EEUU. Esto puede y debe evitarse. Estamos aun a tiempo.
Finalmente, solicitamos se nos permita un diálogo directo con ustedes antes de la votación del TLC Perú / EEUU

35 of 120 Congressmen Peruvians supported by the national land and labor leadership are asking the US Senate to postpone the ratification of FTA and renegotiate the agricultural chapter in order not to deepen poverty, unemployment and drug trafficking in Peru and migration to USA .


Lima, Peru, November 26, 2007


Ladies and gentlemen:


1. We want to assure our support for a higher FTA, in a genuine free trade, to enable the majority of investors in Peru and the United States, which are small and medium, and the rural and urban workers, participate in an efficient and equitable globalization, which ensures the smooth greater poverty and exclusions.


2. We represent into our 120 members unicameral Congress to most of the 28 million citizens of Peru, half of whom live in poverty and 20% in extreme poverty despite the country's GDP has been growing at rates close the 6% from six years ago. We were chosen as the first force in 18 of 24 regions, whose employment and income mostly depends on agricultural production.


3. FTA schemes negotiated by Bush and Toledo, and supported today by the Alan Garcia, has been subject to adjustments in chapters environmental and labor but have been left intact chapters and topics that affect agriculture and textiles directly-as producers, consumer or marketers - to the whole of the Peruvian population.


4. We urge Senators of the United States to postpone the discussion of the text of the FTA (APC) approved a few days ago by the House of Representatives of the United States (285 votes with 132 against), for the following reasons:


A) In our view, the US Senate should ensure the legality of the procedures followed in Peru to approve this treaty before ratifying it. Given our Lawsuits December 2006 and November 2007 the Constitutional Court has just postponed its opinion arguing that it can only do so if it were to adopt the current text of the FTA.

B) It is unnecessary haste in the US Senate since the ATPDEA Andean country -which expires in February 2008 - will be extended to security by some two years in anticipation of NAFTA in Colombia and Panama.

C) It is our firm conviction - that we would like prove - that the adoption of this treaty in its current version would harm US and Peru. By deepening the disadvantages of Peruvian agriculture would enhance regional and social inequality, poverty, unemployment and job insecurity, and the production of coca for drug trafficking. Therefore increase rather than reduce migratory pressures towards impoverished Peruvians to USA. This can and should be avoided. We are still in time.
